Appellate Division upholds transfer of MC College rape case to Speedy Trial Tribunal

The Appellate Division has upheld the High Court order to transfer the trial of the 2020 gang rape at Sylhet's MC College dormitory to the Speedy Trial Tribunal.
A bench led by Justice Md Ashfaqul Islam passed the order today after the state withdrew its application challenging the High Court's decision.
Additional Attorney General Arshad Rauf represented the state, while Barristers Abdul Qayyum, Omar Farooq, and Qamrun Mahmud Deepa appeared for the writ petitioners.
The case involves the gang rape of a woman on the night of 25 September 2020 at the dormitory.
According to the case statement, a group of Chhatra League activists tied up her husband before committing the crime. The victim's husband later filed a case with Shah Paran police station.
On 3 December 2020, police submitted a charge sheet under the Women and Child Repression Prevention Act, naming eight accused individuals.
On 16 August 2022, the High Court issued a rule questioning why the trial should not be conducted in the Speedy Trial Tribunal, following a writ petition filed on 1 August of that year.
Subsequently, on 15 December 2022, the High Court bench, consisting of Justice Farah Mahbub and Justice Ahmed Sohel, directed the transfer of the case to the Speedy Trial Tribunal. The state later filed an application seeking to stay the order.
With the Appellate Division's decision, the case will now proceed in the Speedy Trial Tribunal.
