Finally, the 21-month wait and legal battle of Kabir Uddin, a teacher of a Lalmonirhat madrasa who was falsely implicated and charge-sheeted in a triple murder case, saw a light of hope for justice with the High Court granting him bail on Monday.

The High Court bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman granted a six-month bail to him, confirmed Kabir's lawyer Nasima Kumkum.

"The court took the report into account as an important document related to the case," said Kumkum.

Golam Roisul Islam Rony, the eldest son of Khabir Uddin, broke into tears after learning about the bail order from this correspondent over the phone.

"My father was the only earner of our family. I cannot explain how much unbearable the situation we went through in these months. Finally, we've got the primary justice," he said.

"No one, except The Business Standard, stood beside us when my father was framed in the false charge. Our entire family is grateful to the newspaper," he added.

Nasima Kumkum said they were now trying to obtain the bail order in a quick time so that the teacher could get out of the jail very soon.

Prisoner or hostage?

The post mortem report and the inquest report did not match with the charge-sheet in the murder case.

Kabir Uddin is a teacher and regarded as a nice man in society while witnesses gave contradictory statements in Section 164 about his involvement in the murder.

The court has granted him bail based on all these perspectives, said the lawyer.

How Kabir was falsely framed

On November 13, 2018, Md Oliar Rahman, Al Amin and Atikul Islam – three sons of one Khaleq Quari, allegedly killed three people – Abdul Jalil, Golam Rabbani and Shahidar Rahman – over a land dispute in Taluk Haridas village of Lalmonirhat's Aditmari upazila.

Police arrived at Khabir's house in the same village that morning and asked him about Khaleq Quari's house, looking for Khaleq's three sons in connection with the murder, recounted Khabir's neighbour Rafiqul Islam.

When Khabir, a teacher of West Dhoiljor Dakhil Madrasa, took the police team to his relative and neighbour Khaleq's home, they could not find the three men.

Afterwards, they took Khabir to the police station in a plea of asking him a few questions. Later that day, he was shown arrested in the murder case filed in the afternoon by Jahangir Alam, a son of slain Abdul Jalil.

Police then produced Ramzan Ali and Mehedi Hasan before a Lalmonirhat court to take their testimony.

Ramzan Ali, the primary witness mentioned in the charge-sheet, said as the main culprits had already fled the village, police arrested Md Khabir Uddin in the case.

They were putting pressure on Khabir's family to bring the killers back, added Ramzan who admitted the plaintiff and the police had coerced him to give a false statement implicating Khabir.

Police mentioned Md Oliar Rahman, Al Amin and Atikul Islam, Md Khabir Uddin, Md Shamsul Islam, and his sons, Md Khorshed Alam and Joj Mia, as accused in the charge-sheet submitted on October 10 last year.
