HC dismisses writ seeking IGP Baharul Alam's removal over BDR mutiny report
The court dismissed the writ as the petitioner’s lawyer was not present during the hearing
The High Court today (15 December) dismissed a writ petition seeking the removal of Inspector General of Police (IGP) Baharul Alam after his name appeared in a recent report of the National Independent Investigation Commission on the 2009 BDR mutiny at Pilkhana.
A High Court bench led by Justice Sikder Mahmudur Razi passed the order.
The court dismissed the writ as the petitioner's lawyer was not present during the hearing. Additional Attorney General Mohammad Arshadur Rouf and Barrister Aneek R Haque appeared on behalf of the state.
The writ was filed by Advocate SM Zulfiqure Ali Junu, chairman of the National Lawyers' Council, after Baharul Alam's name was included in the commission's list of individuals linked to the BDR massacre.
Earlier, on 6 December, Junu, who is also a Supreme Court lawyer, wrote to Chief Adviser Muhammad Yunus seeking the immediate suspension or removal of Baharul Alam from the post of IGP.
In the letter, Junu described the 2009 BDR mutiny as one of the most tragic chapters in the nation's history, in which 57 army officers, along with many others, were brutally killed. He said the incident remains a lasting source of national grief and unresolved demands for justice.
He wrote that the inclusion of the serving police chief's name in the investigation report has raised fresh concerns over justice, public trust, and the credibility of the justice system, noting the sensitivity of the matter given the scale and gravity of the incident.
According to the letter, allowing a senior law enforcement official to remain in office while facing allegations, links, negligence, or failure of duty could undermine the transparency and impartiality of the justice process and weaken public confidence in state institutions.
Junu further wrote that one of the key objectives of the interim government is to uphold the rule of law, ensure justice, curb corruption, and restore public trust, adding that justice must be reflected not only through court verdicts but also through timely and appropriate actions by the government.
On behalf of the National Lawyers' Council, Junu made three requests in the letter:
1. That Baharul Alam be immediately relieved or removed from the post of IGP due to his name appearing in the BDR investigation report.
2. That effective steps be taken to determine the roles and responsibilities of all officials concerned to ensure a fair trial and transparent investigation.
3. That the government take immediate action to implement the recommendations of the National Independent Investigation Commission so that justice is visibly ensured for both the state and the public.
