Ex-CJ Khairul Haque denied bail in forgery, murder cases
On 24 July this year, members of the Dhaka Metropolitan Police’s Detective Branch arrested Khairul from his Dhanmondi residence.
A Dhaka court has rejected the bail petitions of former chief justice and ex-chairman of the Law Commission ABM Khairul Haque in two separate cases today (16 September).
Judge Nargis Islam of the Dhaka Second Additional Metropolitan Sessions Judge's court denied his bail in a forgery case. Meanwhile, Judge Jahangir Hossain of the Dhaka 18th Additional Metropolitan Sessions Judge's court rejected the bail plea in a murder case.
One of the cases involves the killing of Jubo Dal activist Abdul Kaiyum Ahad in the Jatrabari area of Dhaka, while the other accuses the former CJ of delivering an unlawful verdict abolishing the caretaker government system, allegedly by manipulating court documents.
Adv Monayem Nabi Shahin, representing Khairul Haque, confirmed the matter, stating, "We filed bail petitions in two separate cases on behalf of Khairul Haque. After hearings, both courts rejected the petitions." He further noted that a total of six cases have so far been filed against his client.
According to the case filed with Jatrabari Police Station, on 18 July, during the July Uprising, Abdul Kaiyum Ahad was shot dead in the Kajla area of Jatrabari. Later, his father, Alauddin, lodged the case with police on 6 August, naming 467 individuals, including the ousted prime minister Sheikh Hasina, as accused.
In the Shahbagh case, the allegations state that Khairul, influenced by former Prime Minister Sheikh Hasina and motivated by the prospect of a favourable post-retirement position, unlawfully altered a short order issued on 10 May 2011. He allegedly published the full verdict of an appeal case on 16 September 2012 with the intent to please the then prime minister.
On 27 August 2024, Supreme Court lawyer Md Mujahidul Islam filed the case with Shahbagh Police Station against Khairul and others. Charges were brought under sections 219 and 466 of the Penal Code for judicial misconduct and document forgery.
On 24 July this year, members of the Dhaka Metropolitan Police's Detective Branch arrested Khairul from his Dhanmondi residence. He was sent to jail the same night and has remained in custody since then.
