High Court restores nomination of BNP candidate Sarwar for Chattogram-2
'The honourable High Court has restored my rights,' Sarwar Alamgir tells TBS.
The High Court has ordered the restoration of the nomination of BNP candidate Sarwar Alamgir for Chattogram-2 (Fatikchhari).
A High Court Division bench, comprising Justice Fahmida Quader and Justice Md Ashif Hasan, passed the order today (27 January), staying the Election Commission's (EC) decision that had cancelled Sarwar's candidacy on allegations of loan default.
The court allowed him to contest the upcoming general election and directed that the electoral symbol "Sheaf of Paddy" be allocated to him.
After regaining his candidacy, Sarwar told The Business Standard, "The honourable High Court has restored my rights. We want a fair election and will accept the people's verdict. We are committed to ensuring a credible and fair election."
Senior advocates Ahsanul Karim and Ruhul Quddus Kazal appeared in court on behalf of Sarwar, while advocates Md Hossain Lipu, ASM Shahriar Kabir and Azimuddin Patwari represented the opposing side.
Earlier, the returning officer concerned had declared Sarwar's nomination papers valid.
However, his rival candidate from the Jamaat-e-Islami, Muhammad Nurul Amin, filed an appeal alleging that Sarwar Alamgir was a loan defaulter.
After hearing the appeal, the EC cancelled his candidacy.
Challenging the legality of the decision, Sarwar later filed a writ petition with the High Court, which led to today's order.
