Writ seeks HC directive against arrest, harassment of ex-CJ ABM Khairul in new cases

A writ petition has been filed with the High Court, seeking directives not to arrest or harass former Chief Justice ABM Khairul Haque in any new case.
On behalf of Khairul Haque, the petition was filed by lawyer Momena Nabi Shahin at the relevant branch of the Supreme Court yesterday (13 May).
A hearing on the petition may be held today (14 May) before the High Court bench of Justice Razik-Al-Jalil and Justice Debashish Roy Chowdhury.
The petition seeks a rule asking why it should not be declared illegal and unlawful to show Justice Khairul Haque arrested in multiple cases, despite his name not being included in the FIRs.
It also seeks an order prohibiting his arrest in any other cases while the rule remains pending.
On 12 May, Justice Khairul Haque was granted bail by the High Court in two cases filed over killings during the July Uprising.
Following the order, his lawyers said there were no legal barriers to his release from prison as he had obtained bail in all cases. However, the state later filed an appeal with the Appellate Division yesterday seeking a stay of the order.
Earlier, on 8 March, the High Court granted bail to the former chief justice in four cases, including one over the killing of a Jubo Dal activist during the July uprising and allegations of verdict forgery linked to the caretaker government system.
Later, on 28 April, the Appellate Division upheld High Court bail orders granted to Khairul Haque in five other cases, including those related to the killing of a Jubo Dal activist during the July movement, alleged forgery of the caretaker government verdict, and cases filed by the Anti-Corruption Commission.
He is facing a total of seven cases.
Khairul Haque was arrested from his Dhanmondi residence on 24 July last year in connection with the murder of Jubo Dal activist Abdul Kaiyum Ahad during the July movement in Jatrabari, Dhaka.
Khairul Haque served as Bangladesh's 19th chief justice from 27 September 2010 to 17 May 2011.
He later served three terms as chairman of the Bangladesh Law Commission before resigning in August 2024 following the fall of the Awami League government.
