Chamber court upholds ex-CJ Khairul Haque’s bail
The former chief justice can now seek release unless he is detained in another case, after the state failed to secure a stay on his High Court bail.
The Appellate Division chamber court has kept former chief justice ABM Khairul Haque's bail intact in a case filed over alleged attempted murder and explosives offences during the July Uprising, clearing the way for his release unless he is detained in another case.
Chamber Judge Md Rezaul Haque passed a 'no order' today (17 August) on the state's petition seeking a stay on the High Court's bail order, according to court sources.
The case was filed with Banani Police Station under the attempted murder and Explosives Act provisions in connection with events during the July Uprising.
The High Court had granted Khairul Haque bail on 10 August, with a rule in the case. The bench of Justice KM Zahid Sarwar and Justice Sheikh Abu Taher passed the order.
Following the chamber court's decision, Khairul Haque's lawyers said there was no legal obstacle to his release.
Khairul Haque was arrested from his Dhanmondi residence on 24 July last year. He was subsequently shown arrested in a case over the killing of Jubo Dal activist Abdul Qayyum Ahad in Jatrabari during the July Uprising and was later shown arrested in several other cases.
