HC verdict on separate Supreme Court secretariat set for appeal hearing on 9 June
On 7 April, the 185-page High Court verdict was published.
The hearing on the state's appeal against a High Court (HC) verdict directing the establishment of a separate and independent secretariat for the Supreme Court within three months has been scheduled for 9 June.
Appellate Division Chamber Judge Justice Farah Mahbub passed the order today (21 May).
Earlier, the state filed an appeal against the verdict.
On 7 April, the 185-page High Court verdict was published.
Earlier, on 2 September, a High Court bench comprising Justice Ahmed Sohel and Justice Debasish Roy Chowdhury delivered the verdict.
In the ruling, the HC scrapped Article 116 of the Constitution, which vested authority in the president over disciplinary matters involving magistrates performing duties in subordinate courts, including posting, promotion and granting leave.
As a result, the authority to control and discipline magistrates serving in subordinate courts has now been vested in the Supreme Court.
At the same time, the disciplinary rules formulated in 2017 for subordinate courts were also scrapped.
Lawyer Mohammad Shishir Monir represented the writ petitioners during the hearing, while Senior Advocate Sharif Bhuiyan appeared as amicus curiae and the then attorney general Md Asaduzzaman represented the state.
