Faridpur-4 constituency boundary to remain in its previous state

The Appellate Division today (5 January) upheld a High Court verdict that declared illegal an Election Commission gazette attaching Algi and Hamirdi unions of Bhanga upazila from the Faridpur-4 constituency to Nagarkanda upazila under Faridpur-2.
A bench led by Chief Justice Zubayer Rahman Chowdhury dismissed the Election Commission's leave to appeal against the High Court ruling, Barrister Humayun Kabir, counsel for the writ petitioners, told reporters.
With this order, the boundary of Faridpur-4 constituency will remain in its previous state, he added.
On 11 December, the High Court struck down the EC notification following a hearing on a writ petition, ruling that the reassignment of the two unions was unlawful.
The Election Commission filed a leave to appeal with the Appellate Division on 21 December last year, which was later placed before the Appellate Division's regular bench after passing through the Chamber Court.
EC lawyer Habibur Rahman said the commission had already issued a revised gazette on 24 December in line with the High Court's verdict, restoring the previous boundaries of Faridpur-2 and Faridpur-4.
Therefore, the court was informed of the decision not to proceed with the leave to appeal. As a result, voting in the two constituencies will take place under the earlier delimitation.

Previously, a writ petition was filed with the High Court by five individuals, including BNP nomination aspirant Md Shahidul Islam Babul for the 13th national parliamentary election in Faridpur-4 and Supreme Court lawyer Md Mahbubur Rahman Dulal.
As part of constituency delimitation ahead of the 13th national parliamentary election, the Election Commission issued a gazette on 4 September, detaching Algi and Hamirdi unions from the Faridpur-4 constituency and attaching them to Faridpur-2.
Faridpur-4 covers Bhanga, Charbhadrasan and Sadarpur upazilas, while Faridpur-2 now comprises Nagarkanda and Saltha upazilas.
