Appellate Division suspends chamber court order; no obstacle to administrator's work at Nagad

The Appellate Division has ordered that there is no obstacle to the activities of the administrator appointed by Bangladesh Bank at mobile financial service (MFS) Nagad.
Following an appeal from the Bangladesh Bank, the Appellate Division today (2 June) suspended the chamber court's order, which had stayed the High Court's dismissal of a writ challenging the appointment of the Nagad administrator for eight weeks.
The bench led by Senior Justice Syed Ashfaqul Islam of the Appellate Division issued this order. Bangladesh Bank's lawyer, BM Ilias Kochi, confirmed the matter to the media.
Earlier on 7 May, the chamber court had stayed for eight weeks the High Court's verdict dismissing a writ regarding the appointment of an administrator to manage Nagad.
During this period, the applicant was directed to file a regular leave to appeal (application seeking permission to appeal).
Previously, Nagad's Independent Director, Md Shafayat Alam, had filed a writ on 2 September last year challenging the validity of the administrator's appointment at Nagad.
After the final hearing concluded, the High Court dismissed the writ as inadmissible on 16 February, delivering a verdict (rule discharge).
In its verdict, the court described Nagad as an 'agent of Bangladesh Postal Department' and said Bangladesh Bank had lawfully appointed the administrator.
