Indian SC refuses early hearing on Article 370

The Centre earlier this week scrapped the provision of Article 370 of the Constitution that granted special status to Jammu and Kashmir.

The Supreme Court on Thursday turned down a plea for urgent hearing of a PIL challenging the validity of the presidential order related to scrapping provisions of Article 370 that conferred special status to Jammu and Kashmir.

The plea was mentioned by Advocate M L Sharma before a division bench headed by NV Ramana and comprising Justice Ajay Rastogi. The case was not mentioned before Chief Justice Ranjan Gogoi because he is at the moment part of the five-judge constitution bench hearing the Ayodhya land dispute.

Sharma, on facing denial, contended that Pakistan may approach the United Nations in this matter.

"Even if they go to the UN, can it stop Parliament from passing a constitutional amendment," Justice Ramana replied.

Sharma further argued that the August 5 special order had superseded the 1954 order that granted special privileges to J&K.

The bench refused early listing and stated that if there are no technical defects the case will come in the regular course before the appropriate bench.

Sharma had filed his petition on Tuesday challenging the amendment, seeking directions from the court to declare it unconstitutional and void.

The government earlier this week scrapped the provision of Article 370 of the Constitution that granted special status to Jammu and Kashmir. Parliament also passed a bill bifurcating Jammu and Kashmir, and Ladakh.
