She was accused of theft. Did that give them the right to chain and drag her?
While Section 59 of the CrPC allows citizens to detain a criminal suspect, chaining, beating, and publicly humiliating a minor violates the law and constitutional rights.
A 16-year-old girl is crying as a young man pulls her along a road in Sylhet, a chain tied tightly around her waist.
She had been detained by locals over an allegation that she tried to steal money from a shop's cash box around 7pm on 7 September. But instead of simply handing her over to police, she was allegedly beaten and dragged through the street late at night.
A 36-second video of the incident, which surfaced on social media on 8 September, has raised a difficult question: when ordinary people detain someone they believe has committed a crime, how far can they legally go?

The answer is simple: not very far. Can an ordinary person arrest a suspected offender? In certain circumstances, yes.
Section 59 of the Code of Criminal Procedure allows a private person to arrest someone who, in their view, commits a non-bailable and cognisable offence, as well as a proclaimed offender.
But the person must be handed over to police without unnecessary delay. If a police officer is unavailable, they must be taken, or arrangements made for them to be taken, to the nearest police station.
Supreme Court lawyer Sudipta Arjun told The Business Standard that the provision does not give general people power to keep a suspect in their custody.
Does that allow people to punish the person?
"There is a difference between detaining someone and handing them over to police and punishing someone because you believe they have committed a crime," Arjun said.
"If someone instead punishes the person they have detained, including by chaining them around the waist and making them walk in public or subjecting them to physical or mental abuse, such conduct is against the law and punishable," he added.
So, even if the initial detention was lawful, it does not make what follows lawful. Deciding whether someone is guilty and what punishment they deserve is a matter for the justice system.
What does the Constitution say?
Article 31 guarantees protection of law, Article 32 protects life and personal liberty, and Article 35(5) prohibits torture and cruel, inhuman or degrading treatment or punishment.
Supreme Court Advocate Barrister Faran Md Araf told TBS that these protections are directly relevant to incidents involving physical abuse, chaining and public humiliation.
"The law also presumes a person to be innocent until proven guilty. So, even if someone is accused of an offence, they cannot be punished by individuals or a group without due legal process," he said.
Could keeping someone in custody itself be a crime?
It can, depending on the circumstances.
Section 342 of the Penal Code makes wrongful confinement a criminal offence, punishable by up to one year in prison, a fine of up to Tk 1,000, or both. Section 341 separately deals with wrongful restraint.
That distinction matters in the Sylhet incident. Investigators will need to establish what happened after the girl was detained, who was involved and how long she was kept there.
What about chaining and dragging her in public?
That goes beyond simply stopping someone from leaving.
Faran said unlawful detention, assault, chaining and public humiliation can violate both domestic legal protections and internationally recognised human rights standards.
"Investigation, determination of guilt and punishment are functions of competent state authorities and courts," he said.
Why does the girl's age matter?
The girl is 16, so she is a minor. That means the incident also falls within the framework of legal protections for children accused of offences.
The central principle remains the same: an allegation is not guilt, and being accused of a crime does not give others the right to punish the accused.
Has this happened before?
The Sylhet incident is not the first case involving minors being subjected to public violence over alleged or perceived wrongdoing.
In May, two minor girls were beaten with a belt on a launch at Munshiganj Launch Terminal after a crowd became angry over their attire. A video showed a young man beating the girls while dozens of people recorded the incident and cheered.
The youth, Nehal Ahmed Jihad, said he had beaten them to "discipline" them as an elder brother and claimed he was trying to prevent a larger attack.
The circumstances were different from the Sylhet incident. But both raise the same question: who has the authority to decide that another person deserves punishment?
The law may allow a private person, in limited circumstances, to make an arrest. It does not give them the power to punish.
In the Sylhet incident, the allegation of theft is only one part of the story.
