SC chamber judge upholds HC's stay order on construction work at Panthakunja Park, Hatirjheel
Earlier on 10 September, a High Court bench of Justice Md Mojibur Rahman Mia and Justice Bishwajit Debnath ordered authorities to refrain from any kind of construction at Panthakunja Park and the open areas of the Hatirjheel waterbody.
The Chamber Court of the Supreme Court today (16 September) upheld a High Court order that restrained authorities from carrying out any construction work in Panthakunja Park and the Hatirjheel waterbody in Dhaka.
Justice Md Rezaul Haque of the Chamber Court passed the order. However, the court said the matter would be heard again next week.
Barrister Jyotirmoy Barua represented the writ petitioners in the hearing, while Deputy Attorney General Khan Ziaul Rahman represented the state.
Earlier on 10 September, a High Court bench of Justice Md Mojibur Rahman Mia and Justice Bishwajit Debnath ordered authorities to refrain from any kind of construction at Panthakunja Park and the open areas of the Hatirjheel waterbody.
The court also directed that public access to these spaces for recreation and other purposes must not be hindered.
The bench issued the rule while holding a primary hearing on a writ petition challenging the legality of using these public spaces for construction under the Support to Dhaka Elevated Expressway Project, which is being expanded from BFDC (Bangladesh Film Development Corporation) to Palashi.
The petition was jointly filed by nine citizens and activists, including Bangladesh Gacch Rokkha Andolon's coordinator Amirul Rajib, Prof Anu Muhammad, Prof Giti Ara Nasreen, Prof Samina Luthfa, writer-researcher Pavel Partha, Prof Adil Mohammad Khan, lawyer Syed Mahbubul Alam, writer-researcher Firoz Ahmed, and Nayeem Ul Hasan.
