The High Court has issued a stay order against Dhaka North City Corporation's (DNCC) decision to set up a temporary cattle market for Eid-ul-Adha at two blocks of Aftabnagar in Eastern Housing and partial areas of Sunvalley Residential in the Merul Badda area of the capital.

The court has also issued a rule asking why DNCC's decision to establish the market should not be permanently cancelled.

The bench of Justice Kazi Zinat Hoque and Justice Aynun Nahar Siddiqua issued this order today (5 May) along with the rule following a hearing on a writ petition filed by a local resident.

Lawyers Mohammad Anwar Hossain and Mohammad Ali Khan represented the petitioner in court.

On 29 April, DNCC had published a lease notice. Column 3 of the notice mentioned "vacant land in Block-M-4, M-5, N-4 (partial area north of the lake), Sunvalley (partial) at Badda Eastern Housing Aftabnagar" for the cattle market. 

Later, local resident Azad Ali filed the writ petition yesterday (4 May).

The petition named the LGRD secretary, the director general of the Department of Environment, the DNCC's administrator, the chief property officer, and other relevant officials as respondents.

Later, lawyer Anwar explained that this is a privately owned residential area. The city corporation has no property there. Additionally, hundreds of thousands of people reside in this area, which also has schools, colleges, and universities that would be adversely affected. Therefore, a resident filed this writ petition. 

The court issued both a rule and a stay order, meaning DNCC will not be able to set up an animal market in the two blocks of Aftabnagar in Eastern Housing and partial areas of Sunvalley this year.

Earlier yesterday, the High Court bench issued a stay order to set up a temporary cattle market for Eid-ul-Adha in the Aftabnagar section of Dhaka South City Corporation (DSCC), following a writ petition by another lawyer.

On 21 April, DSCC had published a lease notice. Column 5 of the notice mentioned "vacant land in Aftabnagar (Eastern Housing) Block-E, F, G, H, Section-1 and 2" for the cattle market. 

Later, lawyer Yunus Ali Akanda filed a writ petition challenging the legality of Column 5.
