No bar to probe former OC over altering FIR in labour leader murder case

The Appellate Division on Sunday upheld the decision of the High Court to continue the departmental probe against Shakil Uddin Ahamed, the then officer-in-charge (OC) of Puthia Police Station, over manipulating the first information report (FIR) in the labour leader Nurul Islam murder case.  

A bench of the Appellate Division led by Chief Justice Syed Mahmud Hossain dismissed the appeal. 

Advocate Yusuf Hossain Humayun and Abdul Matin Khasru stood for the petitioner while barrister Fida M Kamal and barrister Jyotirmoy Barua stood against the petitioner.

Nurul Islam's daughter Niger Sultana filed a writ petition at the High Court on 22 July last year over the altering of the FIR in the Nurul Islam murder case.  

After the hearing on the writ on 16 September, the court ordered the chief judicial magistrate of Rajshahi to carry out a judicial inquiry against the OC.    

The judicial probe found the allegations against former OC Shakil to be true. 

Later, the court delivered a verdict over the writ on December 1. 

In the verdict, the court mentioned that the allegation against the then OC is grave, and is a punishable offence according to the penal code. 

At the same time, the court ordered the police to take punitive departmental measures against the OC after investigating the allegations. 

The court also directed the authorities to send the judicial inquiry report to the Anti-Corruption Commission (ACC) for further investigation and legal steps.  
Former OC Shakil Ahamed had appealed against the HC order.
