High Court accepts ACC explanation on suspended director’s promotion issue

The High Court on Wednesday dismissed a rule issued regarding the promotion of Anti-Corruption Commission's (ACC) suspended director Khandaker Enamul Basir.

Enamul was suspended from his post over an allegation of taking bribes from suspended deputy inspector general of police (DIG) Mizanur Rahman.

As a result of the court order, imprisoned Enamul cannot be promoted as a director general of the ACC.

The High Court issued a rule on January 2 in response to a writ petition that challenged the inaction of the ACC to promote Enamul to the post of director general.

In that rule, the High Court asked the ACC to explain why Enamul would not be promoted as a director general of the ACC.

The court also passed an interim order to keep vacant one among eight posts of director general for him.     

After the final hearing on the rule, a bench of Justice Ashfakul Kamal and Justice Mohammad Alli pronounced the judgment on Wednesday, and dismissed the interim order.

Advocate Mohammad Kamal Hossain moved for Enamul, while Advocate Khurshid Alam Khan was ACC's counsel during the hearing.

Enamul was arrested on July 22 last year in a bribery case filed by the ACC.  

An ACC team led by Director Sheikh Mohammad Fanafilya arrested Enamul from the capital's Mirpur area in connection with a case filed over taking Tk40 lakh in bribes from suspended DIG of police Mizanur Rahman.

The ACC filed the case against Enamul and Mizan on July 16 last year.

ACC Director Sheikh Mohammad Fanafilya lodged the case with its Dhaka District Coordination Office 1 under the Money Laundering Prevention Act.

Enamul is now in prison in that case as the High Court rejected his bail petition.
