The Appellate Division has stayed the High Court's ruling that directed the establishment of an independent secretariat for the Supreme Court within three months.

The Appellate Bench headed by Chief Justice Zubayer Rahman Chowdhury stayed the High Court's judgment until the appeal is disposed of, in an order issued today (9 June).

Attorney General Ruhul Quddus Kazal represented the state during the hearing, while Advocate Mohammad Shishir Manir appeared for the opposing side.
Earlier in the morning, the hearing of the appeal against the High Court's full judgment, which directed the establishment of a separate Supreme Court Secretariat within three months, began.
On 21 May, the state filed an appeal against the High Court's 185-page judgment which was published on 7 April.
Prior to that, the verdict was delivered on 2 September, 2025 by a bench comprising Justice Ahmed Sohel and Justice Debasish Roy Chowdhury.
In its ruling, the High Court annulled the provision of Article 116 of the Constitution that vested the president with authority over the posting, promotion, and grant of leave of magistrates serving in subordinate courts.
As a result, the control and disciplinary authority over such magistrates was vested in the Supreme Court. The court also struck down the disciplinary rules for subordinate courts formulated in 2017.
