Appellate Division stays HC ruling declaring Cumilla-2 boundary gazette illegal
As a result, the election in Cumilla-2 will be held under the redrawn boundary set by the Election Commission. Homna and Titas will together form the Cumilla-2 constituency.
The Appellate Division of the Supreme Court has stayed a High Court order that declared the Election Commission's gazette on the boundary change of the Cumilla-2 constituency illegal.
The chief justice-led Appellate Division issued the order today (20 January) after a granting leave to appeal against the High Court ruling.
As a result, the election in Cumilla-2 will be held under the redrawn boundary set by the Election Commission. Homna and Titas will together form the Cumilla-2 constituency.
Earlier, on 8 January, the High Court delivered its verdict after the final hearing of a writ petition challenging the EC gazette issued on 4 September 2025 that changed the boundaries of Cumilla-1 and Cumilla-2.
Before the change, Cumilla-1 included Daudkandi and Titas upazilas, while Cumilla-2 included Homna and Meghna. The gazette placed Daudkandi and Meghna in Cumilla-1 and Homna and Titas in Cumilla-2.
The High Court had directed the EC to restore the previous configuration and publish a revised gazette within 24 hours.
Following this, the Election Commission and independent candidate AM Matin filed separate applications with the Appellate Division seeking a stay of the verdict.
Previously, in the 12th parliamentary election in 2024, Cumilla-1 consisted of Daudkandi and Titas, while Cumilla-2 comprised Homna and Meghna.
