Abrar murder: Court issues arrest warrant, orders to seize moveable belongings of Anisul Hoque, 4 others

A Dhaka Court has ordered the confiscation of the movable belongings of five accused including Prothom Alo deputy editor and monthly magazine Kishor Alo editor Anisul Hoque in Nayeemul Abrar Rahat murder case.

Dhaka Metropolitan Magistrate Mohammad Jasim passed the order on Wednesday. The court has also directed to submit the report on the seizure of the goods on September 20.

The other four accused are Kishor Alo assistant editor Mohitul Alam, Prothom Alo's head of event Kabir Bakul, executives: Shuvashish Pramanik and Shah Paran Tusher.

"The court also issued arrest warrant against them. If they do not surrender or police could not arrest them, advertisement will be published on newspapers urging them to surrender. Yet if they don't surrender, the trial will begin mentioning them absent," plaintiff's lawyer Omar Faruq Asif told The Business Standard. 

On January 16, Additional Chief Metropolitan Magistrate of Dhaka Kaysarul Islam issued an arrest warrant against them. Then, Prothom Alo editor Matiur Rahman and five other accused took bail.

The other five accused did not appear in the court and also did not ask for bail. As a result, the court ordered to seize their moveable belongings.

Earlier, police submitted a report to the court alleging negligence on the part of Kishore Alo authorities in the death of Nayeemul Abrar. 

Md Abdul Alim, sub-inspector at Mohammadpur Police Station and investigating officer of the case, submitted the report. Following the report, the court issued arrest warrants against them.

In the report, apart from Matiur Rahman and Anisul Haque, Kabir Bakul, Shubhashish Pramanik Shuvo, Muhitul Alam Pavel, Shah Puran Tushar, Jasim Uddin Tapu, Mosharraf Hossain, Md Sumon and Kamrul Hawladar were also accused for the incident.  

Lawyer Omar Faruk Asif said, Prothom Alo editor Matiur Rahman was charged with Section 304 (a) of the Penal Code [death due to negligence]. 

"At the same time, we appealed to find out who else was involved in the incident and who was responsible. The police of Mohammadpur Police Station have submitted the report of the case in a short time." 

He continued, "The report has been submitted accusing 10 people associated with Kishore Alo for the incident. And they are accused in the same Section as the allegations were made. We are satisfied with this report."  

He further said that the court, on Wednesday, took cognisance of the report and issued arrest warrants against the accused.

Nayeemul Abrar, a student of Dhaka Residential Model College was electrocuted during an anniversary programme of Kishor Alo, a supplement of the Prothom Alo for young readers, on the school premises on November 1, 2019.

The 14-year-old boy was taken to the Universal Medical College and Hospital in Mohakhali, 45 minutes after the incident occurred, although the Shaheed Suhrawardy Medical College Hospital was on the opposite side of the venue.

Five days after the death of the ninth-grader Abrar, his father Mujibur Rahman on November 6, 2019, filed the case with the court accusing Prothom Alo editor Matiur Rahman and unnamed others for causing the death by negligence.

On the same day, the court ordered to exhume the body of Abrar for autopsy. 

Simultaneously, the court ordered to merge the new case with the case of unnatural death in the incident, and directed the officer-in-charge of Mohammadpur Police Station to submit a report after investigation.
