Man living in South Korea secures bail using proxy in Khulna; court sues lawyer
The court filed a forgery case against the accused and his lawyer after being informed that the accused had been living in South Korea and had not returned to Bangladesh.
A man accused in a brawl case in Khulna allegedly secured bail by having another person appear in court as him while he was staying in South Korea, prompting a court to file a case against the accused and his lawyer.
Firoz Alam Shaon of Dighalia upazila obtained bail on 16 March, but the alleged forgery was uncovered after the court was informed that he had been living in South Korea and had not returned to Bangladesh.
Judge Fatema Jannat of Khulna Judicial Magistrate Court-4 subsequently filed a case against Shaon and his lawyer, Shahjahan Ali, over the alleged bail forgery.
Police arrested Shaon's brother, Ferdous Alam Setu, on Saturday night (3 October) in connection with the case. He was sent to jail through the court yesterday (4 October).
The case was recorded at Khulna Sadar Police Station on 6 August following a court order.
According to the case statement, Firoz Alam Shaon and his relatives assaulted neighbour Torikul Amin over a land dispute in the Senhati Boroitala Ghat area of Dighalia on 15 March 2025. Torikul later filed a case against five people, including Shaon.
The court directed Dighalia Police Station to investigate. On 23 September last year, investigating officer SI Jamil Hossain submitted a charge sheet naming only Shawn. Witness testimony is now underway at the Khulna Judicial Magistrate Court.
Torikul's lawyer Ajmal Hossain said they discovered Shaon had obtained bail when the court fixed a date for framing charges. The plaintiff then informed the court that Shaon had been in South Korea and had not returned during the period.
In a report to the Chief Metropolitan Magistrate of Khulna on 22 July, Judge Fatema Jannat said Shaon had surrendered voluntarily and sought bail on 16 March through the vakalatnama of Advocate Shahjahan Ali. As the offence was bailable, the court granted bail on a Tk100 bond.
The report said Torikul applied to the court on 23 April, alleging that Shaon had used a proxy to secure bail while staying abroad. On 27 April, Shahjahan Ali applied to withdraw his vakalatnama, citing the incident in which another person had allegedly been presented as Shaon.
The judge said it appeared that Shaon had secured bail by presenting another person in his place. She said it would also need to be investigated whether the lawyer, court officials or employees were involved.
The court later directed Khulna Sadar Police Station to record a case, which was filed on 6 August against Shaon and Shahjahan Ali.
SI Mehedi Hasan Khan, investigating officer of the case, said Shaon had been living in South Korea for a long time and returned to Bangladesh before becoming involved in the brawl. He later returned to South Korea after the case was filed.
"To dispose of the case quickly, a proxy was presented as Shaon in court to obtain bail," he said.
Police said efforts were underway to arrest the other accused in the case.
