Jamaat candidate seeks leave to appeal against HC ruling upholding Sarwar Alamgir’s nomination
Nurul Amin’s lawyer Azim Uddin Patwary said the petition also seeks a stay on the operation of the High Court judgment and an injunction preventing Sarwar Alamgir from participating in parliamentary sessions until the petition is disposed of.
Jamaat-e-Islami candidate Muhammad Nurul Amin has sought leave to appeal against the High Court verdict upholding the nomination of BNP candidate Sarwar Alamgir, who won the Chattogram-2 constituency in the 13th parliamentary election.
Nurul Amin's lawyer Azim Uddin Patwary said the petition also seeks a stay on the operation of the High Court judgment and an injunction preventing Sarwar Alamgir from participating in parliamentary sessions until the petition is disposed of.
A High Court bench comprising Justice Fahmida Quader and Justice Md Asif Hasan upheld Sarwar Alamgir's nomination on 9 July. Sarwar took oath as an MP on the same day.
The dispute began after Sarwar's nomination was accepted by the returning officer for the Chattogram-2 constituency. Nurul Amin subsequently challenged the decision, alleging that Sarwar was a loan defaulter.
Following a hearing, the Election Commission cancelled Sarwar's candidature on 18 January. Sarwar then filed a writ petition with the High Court challenging the EC's decision.
On 27 January, the High Court stayed the EC order cancelling his candidature. Nurul Amin has now challenged the High Court's subsequent verdict upholding Sarwar's nomination by seeking leave to appeal before the Appellate Division.
